David Marchant’s Offshore Alert Conference is arguably the most unique legal conference gathering in the country. As financial crimes lawyer Jack Blum once famously said in a Wall Street Journal article: “It’s like that famous bar in ‘Star Wars’, where they all come together – the good guys, the bad guys, the seriously guilty – and they all exchange information on neutral territory.”
I’m privileged to once again present on an important fraud recovery topic at this year’s Miami gathering with my Bernhoft Law principal partner Dan Treuden. After a year of dreaded “Zoom” meetings, we’ve sorely missed the in-person connections with our friends, colleagues, and adversaries. This year’s conference promises to be both informative and eventful.
Our panel will explore using the civil Racketeering Influenced and Corrupt Organization (“RICO”) Act to recover damages for serious frauds, including treble damages, attorney’s fees, and costs. We’ll dig deep into civil RICO’s unique pleading requirements, jurisdictional considerations, and general litigation strategies.
